1. Terms of Use & Privacy Policy

 

The terms of use and privacy policy provided on this page ensures that all clients read and understand the conditions pertaining to hiring Shecktor Photography for their event, occasion, or personal one on one photo session. Pleas be aware that the photographer maintains all rights to the photos taken of their client but allows the client to print, display, and otherwise make use of the photos they are provided with assuming the photos are not used, displayed, printed, or distributed for commercial uses and all copyright and watermarks remain as part of the photos taken.

2. Use License
 

Permission is granted to obtain one to three copies of the materials (Client Photographs) taken by Shecktor Photography for personal, non-commercial transitory ownership only. This is the grant of a license, not a transfer of title, and under this license you may not:

modify or copy the photographs; use the photographs for any commercial purpose, or for any public display (commercial only); attempt to decompile or reverse engineer any photographs digitally; remove any copyright, watermarks, or other proprietary notations from the photographs; or transfer the photographs to another person (unless the other person is in the photographs) or "mirror" the photographs on any other server.

 

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Shecktor Photography at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer
 

The materials on Shecktor Photography's website are provided "as is". Shecktor Photography makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Shecktor Photography does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations
 
In no event shall Shecktor Photography or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Shecktor Photography's Internet site, even if Shecktor Photography or a Shecktor Photography authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

 

 

5. Refunds

 

Refunds shall not be given in the event of last minute cancellation (less than seven days notice) under any circumstances. The client hiring any photographer for Shecktor Photographer understands and agrees to these terms. If for some reason a cancellation is needed, it must be made in no less than seven (7) days. Provided the conditions are met, the client will then receive a full refund. This will only occur if the cancellation was made seven (7) days or more prior to the date of the proposed photo shoot or event. In the case of wedding cancellations, these terms do not apply with the seven (7) day minimum requirement. A full refund will then be given under the aforementioned conditions.

 

 

6. Confidentiality

 

 

Photographer in the course of performing the Services hereunder, may gain access to certain confidential or proprietary information of the Client. Such “Confidential Information” shall include all information concerning phone number, home address, and email. The Photographer agrees to hold all such Confidential Information of the Client in strict confidence and shall not, without the express prior written permission of client, (a) disclose such Confidential Information to third parties; or (b) use such Confidential Information for any purposes whatsoever, other than the performance of its obligations hereunder. The obligations under this Section shall survive termination or expiration of this Agreement. 

 

 

7. Delivery

 

Photographer will deliver the photographs as an individual or as multiple emails unless otherwise specifide. This includes a request for X number of prints in addition to a Photo CD. Photo CDs and prints are subject to include shipping prices. Delivery of photos may include one or more method mentioned above (I.E email & photo CD, X number of prints & photo CD, or all three methods)

 

 

8. Termination

 

(a) Either party may terminate this Agreement for convenience by providing a seven (7) day written notice (“Termination Notice”) to the other party. (b) If a party violates its obligations to be performed under this Agreement, the other party may terminate the Agreement by sending a seven (7) days notice in writing. Upon receiving such notice, the defaulting party shall have seven (7) days from the date of such notice to cure any such default. If the default is not cured within the required seven (7) day period, the party providing notice shall have the right to terminate this Agreement. 9. Assignment

 

Photographer shall not assign any of their rights under this Agreement, or delegate the performance of any of the obligations or duties hereunder, without the prior written consent of the Client and any attempt by Photographer to so assign, transfer, or subcontract any rights, duties, or obligations arising hereunder shall be void and of no effect.

 

 

10. Notices

 

Any notices, bills, invoices, or reports required by this Agreement shall be deemed received on (a) the day of delivery if delivered by hand during receiving party’s regular business hours or by email before or during receiving party’s regular business hours.
